Can I get ACA coverage with an ITIN?

Having an ITIN by itself does not make you eligible to buy Marketplace coverage, because Marketplace eligibility depends on being lawfully present in the United States, not on which kind of taxpayer number you file with.

The distinction matters for mixed-status households, which are common across South Florida. A parent who files with an ITIN and is not lawfully present cannot buy a Marketplace plan, but their lawfully present children or spouse usually can, and the family’s income is still used to work out the subsidy for those who are eligible. Applying for coverage for an eligible family member does not require the ineligible member to provide immigration information.

How it works

The Marketplace asks about immigration status for the people applying for coverage, not for everyone in the household. Household size and income are still counted in full, which usually works in the family’s favor: a larger household raises the poverty guideline used, which can increase the credit for the members who are eligible.

What changes it

Status changes change eligibility, and gaining lawful presence opens a Special Enrollment Period rather than requiring you to wait for open enrollment. An ITIN is still useful here even where it does not create eligibility, because filing taxes is how the premium tax credit is reconciled for the household members who do receive one.

What to do next

If anyone in your household is a citizen or lawfully present, it is worth applying for them, even if you are not eligible yourself. This is a conversation worth having with someone in your own language before assuming the answer is no.

Related questions

Will applying put my family at risk?

The Marketplace asks about immigration status only for the people applying for coverage. Information about non-applicants is not requested for that purpose.

Does our whole income still count?

Yes. Household income is counted in full, and household size includes everyone you file with, which can increase the credit for eligible members.

Can I get emergency Medicaid instead?

Florida has limited emergency Medicaid in certain circumstances. That is a separate program from the Marketplace and worth asking about directly.
